I know some are arguing that Franken should reconsider resigning at all, but I assume that’s not what’s going to happen. I’m more concerned about making certain that he takes every imaginable precaution to ensure that Mitch McConnell doesn’t try to leave his seat vacant indefinitely for one bogus reason or another. It’s crazy that we’ve reached a point where this is necessary, but he probably needs to make his resignation expressly contingent on a binding, written commitment for his successor to be sworn-in sixty seconds after his resignation becomes effective, such that a failure to complete her swearing-in would nullify his resignation altogether. That looks crazy to me even as I’ve just typed it, but trusting McConnell would be even crazier, wouldn’t it?
In addition to the above-discussed precaution, I think Franken should probably say he’s not going anywhere until Doug Jones is seated, to minimize the risk that McConnell decides to attempt some shenanigans on that front based on the fact that Moore still has not conceded.
