    Perry would just lower the bar.

    As written, the constitution allows a Supreme Court decision to be vetoed by Congress if (1) 2/3 of both houses agree, and (2) 3/4 of the state legislatures agree.

    He just wants to bypass the required ratification by the state legislatures.
