      he was already on the Supreme Court, it's a different situation, mostly symbolic.

        it was the first step in pushing him off the Court, I don't agree.  And I think the difference between Fortas or Burger mattered a good deal.

        I guess I'm having trouble seeing what your point it. It all changed with Bork is rather vague. Bork was a radical who had laid out his views for all to see.  That is why he was rejected.  There are some who want to paper over this by making it seems as though its about civility or the process.  I think it's important to understand his rejection was about substance.
