    The timing couldn't be better. I don't Scalia would violate his principles to make Perry look bad, but this is probably a golden opportunity, from his perspective.

      a reason. Scalia is like the champion high school debater. He could take either side of an issue and debate his way to victory. It's totally and completely out of character for him to be siding with a convicted black man here. He is doing this for a reason.

        I have a very low opinion of Scalia, but I think it may just be that the idea of using race as an explicit factor is too much even for Scalia.  He may have his sketchy aspects (though being able to win either side in a debate is something most lawyers should be able to do.  It's an important skill to have, professonally), and he has delivered some twisted logic, he is still an actual judge somewhere in there.  I think the facts of this case are so insanely egregious that even Scalia won't let it pass.

        I suspect not only that the there are four votes to hear the case, I'm goign to guess there are 9 votes to overturn.  I don't see this case as even being close.

        I am going to guess that Scalia konws that not offering this up to the full court would be such bad practice that his credibility would take a big hit if he didn't.  I think somewhere, Scalia is enamoured of the courts that he doesn't want to go that far in making them look bad.

        Intelligent, passionate, perceptive people will always disagree, but we should not let that disagreement, however heartfelt, lead us to become deaf to those better angels of our nature.
