    Even without regulation, people would have only gone to circuses with a relatively low risk of dying in a giant inferno.

      ...the circuses would have to sue to prevent anyone from disseminating information on which circuses presented a high risk of dying in a flaming inferno, and preventing circuses with low risk of dying in a flaming inferno from advertising themselves as such, lest they defame the reputation of circuses that can't make that claim.
