      Infringing is a civil, not criminal act. It all gets down to whether there are enough damages to sue over. If one person cooks up some infringing homebrew, they probably get away with it. If lots of people start infringing, it may be worth it to the inventor to sue individuals at a loss so the other infringers back off.

        They've managed to criminalize the "private" use of their IP and get government involved in it.
