      I saw Linda Greenhouse at a SCOTUS preview event last week; she insists Justice Ginsburg is going nowhere and doing fine.

        given by Justice Ginsberg only a few weeks ago. He said she looked unbelievably frail. Pancreatic cancer and its treatment is tough, but then so is Justice Ginsburg. My husband marveled at the stories she told about her life and the obstacles she overcame.

            winning -- or losing, and thus bringing home the reality of Republican extremism?  (I think winning helps more, but he seems to be under the impression that he's convinced people that PPACA is right -- or that he can easily do so, so who knows which he thinks is better?)

            In my avatar, the blue bars show how many want Reps who COMPROMISE; the aqua bars show who wants Reps who STAND FAST no matter what. (Left=Overall; Center=Democrats; Right=Republicans.) And there's the problem!

              reconciled to progressive decline

              Obama acts as if this were inevitable, and so do I myself fear it to be.  I see him as a good, intelligent, and capable man who fights a damn good rear-guard action.  The tides of history are not always to be turned and saviors are not always to hand.  Optimism is beyond me, which I realize makes me inelibible as an organizer.

          •  Perhaps the Obama administration (0+ / 0-)

            decided it was better to risk a political disadvantage than risk the legal outcome on this case.

            If a vacancy on the court should occur, I can certainly imagine Republicans refusing to confirm any nominee proposed by the Administration with HCR on or close to the docket, which could result in a 4-4 tie. The effect of that would be the lower court ruling would stand, making HCR constitutional in some circuits, unconstitutional in others. A mess.
