    But that doesn't matter in modern America, does it? Might has completely superseded right and the rule of law.

    If you accept that the president has the power to do this, there is nothing, in principle, stopping him from unilaterally ordering drone strikes on the protesters currently gathered in New York to oppose the unfettered power of Wall Street.

    Why doesn't he do so? Well, it probably wouldn't look very good on the evening news. However, we should not be relying on the fear of bad PR to guarantee our fundamental Constitutional rights.
