    Constitution against knowingly manipulating voters with fake stuff like this, which is the provision the lawyers argued. The key was whether Cortes was really part of the sham. Still, as you say, a case could go forward without her -- knowing what we know about the Tea Party's involvement.

      It seems clear it was not Cortes.  So continue the investigation and find out who it was.  Then prosecute them for the felony.  Pretty simple IMHO.
