I'm sorry but WTF is that about?

They were charged with criminal trespass and issued citations that mean they can't return to the protest site.

I don't remember there being anything on the books that says, "one time trespass per offender" or "free speech ends once a citation has been issued".

This use of legal riders to current law by local officials has got to be challenged! Yes, you may have trespassed, but that is where it ends. Or yes, I did not follow orders from the police and was cited and that is where it ends.

You cannot place additional restrictions on someone just because they are exercising their rights to free speech. The whole local rules are a scam to break up the protest. The lawyers should start petitioning the courts to stand down on these activist decrees from the bench.

    •  It's like the drug exclusion zones (0+ / 0-)

some municipalities have a law that if you are arrested for drugs in certain areas you can't return to that area for a set period of time.  It's not indefinite, tho, so I don't know that those citations would pass a judge.

    •  In most cases, it's given as an alternative (0+ / 0-)

Either they take a minor charge with the agreement that they'll stay out of that area, or they refuse and get a more serious charge - or they take the minor charge, return, get arrested again in the same spot, and then face a greater penalty the next time they appear in front of a court.
