I doubt that the IRS would do much initially, though it is clear that these folks are not running a religious institution that is exempt from the filing requirements of 501(c)(3). I have no idea what Delaware law is on this. Given how slack Delaware is on other corporation law, I wouldn't be surprised if anyone could call themselves religious in Delaware, but incorporation papers isn't what the IRS uses for determining whether you qualify for the exemption from the filing requirements.

Clearly, the folks running the website knew that, since they switched their pitch to educational from church body for the website. Yes, these folks are breaking the law.

    •  Does anyone live in Delaware? (none)
Maybe they could do something more?
    •  Not legal (4.00)
It is not legal to raise money under the banner of a 501(c)3 organization if you have not, at minimum, applied to do so.

While in theory one can begin raising money after applying, but prior to final IRS approval, credible nonprofit advisors do not suggest raising money as a "nonprofit" until one has obtained a final IRS determination, even if you have applied.

If the organization is not approved by the IRS, but you've gathered monies by telling donors that their contributions are tax-deductible, then you have a giant financial and legal mess on your hands.
