    But spend a few years as an active transportation advocate, and you'll learn that the general rule is unless a driver is falling-down-drunk or smoking crack at the time the police arrive, the phrase "the driver remained at the scene and was not charged" is an all too common one.

    Sad but true.

    My (probably naive) hope is that perhaps this incident will now spark some demands that we begin to take motor vehicle violence on our streets more seriously from now on.

    In a just world, this person will never be allowed to operate heavy machinery in public again.  If I ran someone down with my fork truck next week, I'll tell you right now I'd never get warehouse work again...

      not falling down drunk You have to detain to get this kind of evidence. Indianapolis police learned the HARD way that without this evidenc for the court, driver can still be charges as drunk drive.
