    What this law really means is that if you are here illegally, you don't leave.  If you are a migrant worker you have to stay year around. If you have family or community or work connections you don't even think about returning home because you know you probably won't ever get the chance to come back to the US.

    This law basically traps people here. It actually increases illegal immigration by making it permanent. The first thing an immigration lawyer will tell an undocumented immigrant is to not even think about leaving until every legal avenue is exhausted.

    The last paragraph is simply incorrect. As long as an undocumented immigrant remains in the US (i.e. doesn't leave) there are several ways to get an "adjustment of status".

      What the law is really saying is that if you are here illegally and harbor any hopes of one day becoming a legal resident of the U.S., the smartest thing that you can do is to leave the country as soon as possible. The sooner you leave, the sooner you can apply to come back legally. That is actually the first thing an immigration lawyer should tell an undocumented immigrant. But we know there are legions of unscrupulous lawyers who make a living providing false hopes to illegal aliens.

        I have personal experience with this through family members, undocumented friends and people in the community. You obviously know very little about immigrant rights.

        The last thing you should even think of doing is leaving the US. Not only will competent lawyers tell you this, but civil rights groups will say the same thing.

        Would you leave if it meant you would be barred from you family, friends and community for 10 years? Factually the bar for people from Latin American countries is practically much longer since quotas make re-entry near impossible.

        Competent lawyers work very hard to get undocumented immigrants an green card without leaving the country and many times they are successful. Once someone leaves the country, the chance of getting a green card, even after 10 years, is near zero.

          person who does not fall under one of the special provisions (i.e. VAWA, etc.) get a green card?

              Unfortunately, marriage will not cure the problem. In most cases where an alien spouse last came to the U.S. by entering without inspection (EWI), the beneficiary would be required to leave this country in order to complete processing in their home country.

                Many undocumented immigrants came with inspection. I suspect you don't even know what that means.

                  Some unauthorized persons are here because they overstayed their visas, some because they made an illegal entry (without inspection). And for the most part, when we're talking about people who've been here for "25 years" who might presumably be given amnesty, we're talking about people who made an illegal entry.

                    Many of the people brought here as kids were brought here with inspection, one prominent example being Jose Vargas. Also the term with inspection doesn't mean visa, there are lots of people who entered with inspection without having a visa (that is before 9/11).

                    That doesn't change the fact that immigrant rights groups, that is the people who are truly on the side of undocumented immigrants and their families, advise the people who came without inspection to stay put.

                    Leaving after 25 years of building a life here without any real chance of getting back would be pure idiocy.

                      hope of another amnesty. Luring people into living their entire lives in the shadows, subject to all manner of exploitation, hoping that once again the amnesty gods will smile upon the suffering masses. Absolutely disgusting.
