    in regards to ILWU?  

    My understanding is that Operating Engineers are doing longshoremen's work.  Is that true?

      I don't know what the exact wording is, or where the document could be found.

      Presumably loading and unloading ships is the "longshoreman's work", since that is exactly what they do.

        I can see the wording ranging from, "EGT will exclusively contract with iLWU for ...", to "EGT will negotiate with ILWU, and if EGT and ILWU reach an agreement, EGT will contract with ILWU." This is a very wide range for being written into a lease.  Then what are the consequences of a breech, as specified in the lease agreement,  by EGT on this term?

      .... expressly set forth on
      Exhibit G-2 hereto, in connection with the operation of the Ship Dock and the Barge Dock, the handling of cargo at the Facility and the operation of the Facility.
      See Decl. of Michael A. More, Dkt. #16, at Exhibit A, §6.3. The referred Exhibit is an agreement between the Port and the Union known as the “Working Agreement.” According to the Port, the Working Agreement requires the Port to employ Union workers for a wide range of
      traditional longshore jobs and virtually all waterfront and cargo-handling work.

        If so the ILWU should stay as non-confrontational as possible while building up and documenting the case for damages and punitive awards from the court.

        I would hate to see ILWU works get far less in a court win, because of reduced damages and punitive awards resulting from unwise actions by the members.

        If the probability of a win in court is low, then confrontational action is the answer to getting what the ILWU members want that the courts will not provide.
