    are used to discriminate against older workers as well as suppress wage demands.   For example, a displaced American worker has no private right of action under the H-1B program.   A displaced American worker's only recourse is to prove that his/her employer violated Title VII of the Civil Rights Act of of 1964 by replacing him/her with a foreign worker on an H-1B work visa.  

    The banking and insurance industries have been replacing older American hi-tech workers with H-1B visa holders for more than a decade.  Kevin Flanagan committed suicide in the Bank of America's Concord Technology Center parking lot after having to train his guest worker replacement back in 2003.  John Miano became a labor rights activist and attorney after being displaced by an H-1B visa holder at AIG.
