    What are they claiming they are doing with this?

    This is mind boggling. What problem do they claim they are solving?

    Clarknt67 had a diary up yesterday on ultra right wing conservative attorney Tom Marcelle being nominated by the new Democratic County Executive for Albany County Attorney.

    One of the highlights on this guy Marcelle's resume was arguing in favor of an abusive husband getting his guns back after they had been confiscated by the cops.

    We are trying to work the County Legislature to stop this guy but as it stands at the moment he is likely to get approved for the appointment. He has higher judicial aspirations and this would be a huge boost for him getting there in the future.

      legal ethics issues there.  There's a first amendment right to petition the government for redress of grievances, i.e., getting back the guns, and a lawyer is not his client, but if there is a known risk of imminent criminal conduct or harm to others, the lawyer can't ethically support that position.  Of course, it's all grey areas.  Was this before or after conviction?  What's the statutory standard?  Is this in an urban or rural area?   I might not take that case in all instances, but there might be some where i'd hold my nose and do it.  Thankfully, i'm not qualified for that kind of practice.
