  •  It is "legal" in the de-jure sense.... (11+ / 0-)

.....but the US has diverged so far from the rule of law, that such behavior is de-facto "illegal".

While I don't hold Obama in high esteem, that doesn't mean I would say he's the Devil Incarnate and the lessor of evils. He is merely the lessee of evils.

..."legal" and "possible". Is it legal for an officer to direct you to a place without witnesses, beat the fuck out of you, claim you assaulted an officer and resisted arrest, and send you to prison? Nope. Is it possible? You better fucking believe it.

In the grandparents posts, I'd go as far to say that if someone behaved that way to an officer just trying to do his job in front of me, I'd probably look the other way when the pepper spray came out. It is one thing to stand up for your rights, it's another to be a massive dick for no good reason. (And I suspect the majority of Americans feel the same way).

On top of the civics lessons we give our children, we should also give them one in practicality - you should do your best not to upset people with power over you, because they just might decide to exercise this power, and ruin your life. It isn't right, but it is true. In the end, rules are always for other people.

The corollary to that, of course, is that if you do decide to upset people with power over you, then take no half measures. Go large, and go public.

It's not 11th dimensional chess; it's just chess. And he's KICKING YOUR ASS.

      •  The legal system is the practical arbiter of (0+ / 0-)

..what is and is not legal. Regardless of what the spirit and letter of the written law may be, in practice the law is whatever the legal system says it is.

When the practice of law is governed by the spirit of the written law, then you have a nation of laws; where what is and is not legal is written in black and white.

When the practice of law is governed by the interests of those who have control over the legal system, then what is and is not legal is determined by those interests.
