    although I take your point.  It is possible to redefine "consent", just like you can with other situations. (E.g., the law defines implied consent in many situations where the patient has not granted permission.)

    But it could involve HIPAA, which makes releasing medical information, even to police, without the patient's express approval, a federal crime.

    So if the woman refused the procedure, how could the physician report the "crime" of refusal, since the physician would be violating a federal crime in order to enforce a state regulation.  

    The fact is, this whole bill was the usual ill-thought out, oppressive, right wing screw up.
