    In most states, my own IANAL status isn't up to date in Indiana so I'm not sure about it, but in most states a diminished capacity is very difficult to prove.

    This is actually a very good check and balance, because it prevents a party such as Ms. or Dr. or whatever Taits from using what I think is called the Leonard Cohen precedent of arguing that what a layperson might perceive as a diminished chord is actually the special chord that King David used to please God and thus establish himself as the second king of Israel and - this is of particular importance in this case - of a song from his second marriage as the model for judicial wisdom. (David's first wife, for what it's worth, was one of the greatest opponenets of capital punishment.)
