    The president has no say, according to this. These five have to agree, to send someone to GITMO.

    Only if the head of the FBI, Homeland Security, the Attorney General and two others concur that there would be a national security threat if he is tried in civil court, will a suspect be transferred.

    The FBI will handle future civil prosecution of terrorism cases, like they did of the underwear bomber and the times square bomber.

    As I quoted, legal thinkers say it will be almost impossible to get someone transferred to military detention.
