    Once again, this is compensation. This is like putting an entailment on property. It's simply not valid. And it isn't the employer's money. It's money they are giving to the employee as part of their compensation.

    If I give you money as part of your paycheck, would it then be okay with you if I said what you could and couldn't spend it on?

    The government is giving them a tax exemption to do this. It is up to the government to set the rules (based on what is fair for all employees).

      But we're talking about an agreement for future compensation. The employer  says that in exchange for your labor i will give you A B and C.

      The employee then either accepts that package or they do not accept it. Only after they have agreed to a compensation package, does work occur and payment happen.

      If the employee says i also want 'D' (birth control) and the employer refuses; then the employee either accepts that or starts looking for another job.

      No discrimination, not compulsion. Two parties come to an agreement or they do not.
