  •  The law is chock full of undue burdens (0+ / 0-)

so of course I agree with you. The Texas Legislature is no more qualified to play doctor than any other, and far less qualified than most.

But pre-abortion sonograms are a standard of care for sound reasons. All licensed clinics in this state -- like most, if not all others across the country -- performed ultrasound scans before this law was ever dreamed of. The sonogram requirement itself does not present any obstacle; in a state the size of France, with clinics concentrated in urban areas, it's the imposition of an arbitrary waiting period afterward that can and does impede a woman's access to care.

Additionally, federal Judge Sam Sparks ruled that the state-mandated speech from the physician and the involuntary disclosure of personal information from the woman are violations of the First Amendment.

These requirement have been ruled unconstitutional when they were imposed by other states in other federal jurisdictions, but like the Texas Lege, the Fifth Circuit Court of Appeals never met an undue burden it didn't like.

Now women in Texas are reduced to non-person status, and physicians are faced with criminal sanctions and loss of their licensure and livelihood should they fail to enforce the state's will.

THAT, and not some eye-catching graphic of an ultrasound wand, is the real violation here, with very scary implications for the future.

"Texas is going to shrink government until it fits into a woman's uterus." -- Texas State Sen. Leticia Van de Putte
