  •  Yes, stop and frisk too, (5+ / 0-)

but there's one difference: stop and frisk mainly affects minorities (directly).  There's a large segment of the population that knows that they'll never be stopped and frisked.  Kettling affects all segments of the population and even people who aren't part of the march but get swept up in the indiscriminate arrest (kettling seems to my not-legally-trained mind as a form of arrest).  Everyone can identify with the targets of kettling, which is how we get everyone to identify with the targets of the beatings, and stop and frisk.

If we want everyone to identify with the targets of stop and frisk, I think it's by way of saying that stop and frisk is like having to go through airport security on your way to the corner deli.

    •  Actually until we get stronger nominees to the (5+ / 0-)

Supreme Court who will uphold the Constitution people can sue all they want but the 1% isn't afraid of thoses lawsuits. They've already made a cost/benefit analysis and know how difficult and expensive it is for a person to sue for aa violation of civil rights. That's why so many have strong feelings about people who think there is no difference between the candidates.

    •  When one segment of the population is (6+ / 0-)

singled out for separate treatment -- i.e. segregated -- the whole population is effectively segregated.  It's not possible to separate one without also separating the others.
When the group is larger, the segregation may not be as obvious, but on some level it is perceived.  Indeed, the targeting of one group for "special treatment" is designed to impress on the whole population that there's a hierarchy and they'd better behave themselves.

Breitbart's "Behave yourselves, behave yourselves" was really a crie de coeur.  On some level he recognized the disobedience as a real threat to the culture to which he had committed himself.
