    It's like the expansion of executive powers.  The 'Pubbies are all for it when a Republican holds the office, but when a Democrat invokes the new power, he's a tyrant.

    The fact is, it doesn't matter what party or person holds office.  The expansion of power itself goes directly against the Constitution which is designed to prevent any person or institution from gaining too much power.

    In this case, the Fourth Amendment would seem to apply:

    The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
    Does this sort of all-seeing eye constitute an unreasonable search?  It could be argued that scooping up all communications is no different than agents overhearing conversations on park benches.  Then again, the FBI generally requires a warrant to tap your phone or bug your house.  Why should the NSA be any different?

    The problem is, the ship has sailed.  This is reality, depressingly enough, and it's just a matter of time before this technology is misused to oppress us.

    •  The reason it's different is the Supreme Court's (3+ / 0-)

      ruling recently that the use of a GPS tracker on a car must be done through a court order and it couldn't be done on a fishing expedition, even though doing it without a court order would cost far more than just using available technology like the GPS device.  Basically the court said (iirc) that the surveillance could not be done by just bugging his car to see where he went.  This Total Information Awareness is that GPS device for everyone all over the world who communicates electronically (I would guess there might be people who are not using electronic means, but that would be a shrinking number (and yes, I know I could go talk to someone face to face, but cameras exist too)).  However, given the power of the NSA compared to the courts - well, we saw with FISA who wins there.

      Oh, and Hi, NSA!  I think you folks are GRREEAAATTT!
