  •  No, sadly, you are wrong (0+ / 0-)

To prove you are wrong I invite you to read up on: Sanford Police Determine Zimmerman used self-defense via SYG law therefore NO ARREST

You see, sadly, under SYG - there is NO judge involved because the killer is not allowed to be arrested so long as the police determine the killer used self-defense under SYG.

In order for a judge to be involved there has to be an arrest.  With no arrest, no judge.

I understand it is hard to wrap your head around this screwed up law -- but sadly -- a judge is NOT involved when the SYG is determined at the police level.

Thus, it is the POLICE (not a judge) who determined that Zimmerman "engaged in lawful activity"

Therefore, the police did not arrest Zimmerman.

I think the cops are wrong and I think Zimmerman was engaged in UNLawful activity (stalking) but the Sanford Police made their call and their call was:
Zimmerman "engaged in legal activity" - thus NO JUDGE

And, sadly, since the police determined that - the rest of SYG says Trayvon's parents  are PROHIBITED from suing Zimmerman in Civil Court for Wrongful Death.

the fact they did not arrest does not mean he was engaged in a lawful activity.  The police are not a trier of fact.  You do not know the role of the police, the prosecutor, the judge and the jury in the determination of what is and is not a lawful act.

And even though lawyer after lawyer has tried to explain it to you, you still persist in a false presumption.  So I'm leaving the diary b/c it is based on a faulty premise which the author is either incapable or unwilling to accept.

Police Chief Lee said Zimmerman was engaged in lawful activity

Read the Interview of Police Chief Lee:

Q: Q. Why was George Zimmerman was not arrested the night of the shooting?

CHIEF LEE: Mr. Zimmerman provided a statement claiming he acted in self-defense, which at the time was supported by physical evidence and testimony. By Florida Statute, law enforcement was prohibited from making an arrest based on the facts and circumstances they had at the time.

        Q. If Zimmerman was told not to continue to follow Trayvon, can that be considered in this investigation?

CHIEF LEE: The call taker’s suggestion is not a lawful order that Mr. Zimmerman would be required to follow.

See, Chief Lee just admitted the police thought Zimmerman was engaged in lawful activity.

I don't know how much more blatant the facts can be that NO JUDGE was involved when Sanford Police let Zimmerman get away with cold-blooded murder on the idea that he used self-defense via SYG law.

If it were not for public outrage the FBI nor DOJ would be involved as Sanford Police CLOSED their investigation on 3/16

Also, the lawyers here are NOT  saying my Diary is wrong - they are giving other avenues Trayvon's family can take.

I know it's hard to wrap your head around this screwed up law as it truly does end the Common Law we are all used to.

    •  In order for a judge to be involved in a CRIMINAL (0+ / 0-)

case, there has to be an arrest.  But in order for a judge to be involved in a CIVIL case, all that's necessary is for somebody to file suit.  And absolutely nothing in the statute relating to civil liability says that the decision as to whether the SYG law applies is up to the discretion of the police department, rather than the judge and jury in the civil case.
