The privatization of Social Security I find a compelling theoretical case, however, because I don't think there is any question that the conservative half of the court would find the requirement that all Americans make mandated payments to private companies in that particular case to be uncontroversial.
Does not sound like much justice does it?  I too have wondered how they would rule if the Eddie Munster (Paul Ryan) Medicare Act would be passed into law.  In functionality isn't that the same thing as the ACA?
My bet is that the right wing hacks on the USSC would justify such a law by saying it is financed through a "tax" instead of a "penalty".   I'm no fan of the individual mandate myself and would have preferred Obama's original Public Option alternative instead.  But IHMO, if this all comes into fruition and the entire ACA is struck down, it will be truly a sad day in American judicial history, only overshadowed by Bush vs Gore.

Mr. Boehner, where are the jobs?
