  •  I Think VClib Has It Right That... (5+ / 0-) Tuesday, Obama was clear that he only referring to the Supreme Court overturning a major piece of economic legislation based on narrow reading of the Commerce Clause, something it hadn't done since the mid-1930's.

    Had that been part of his original statement on Monday, there would be no controversy.  (I also agree with Laurence Tribe that Obama on Monday did not clearly say what he really meant.)

    Still, the media largely ignored that Obama's statement on Monday about an "unelected group of people would somehow overturn a duly constituted and passed law" was what "conservative commentators" had been saying for years.  Note that that bit is missing from the CBS News clip above (and most others).
