    is based on Zimmerman's observations. It doesn't matter that Martin actions were innocent if they seemed to be sinister.

    More to the point, if the State has to address it in closing its case will have gone off the rails, because it doesn't really matter whether Zimmerman's suspicion was reasonable or not.

    •  But for a court, judge or jury to consider (0+ / 0-)

      whether or not to find probable cause to move forward past the initial determination of whether or not Zimmerman's claim to "stand your ground" is sufficient to explain the events, and free Zimmerman from standing trial, his reasoning for the events of the night will come into question.

      Most certainly his claims of Martin's behavior being "suspicious" will figure prominently, because they are the basis for Zimmerman's further actions that night, per the released 911 tapes/transcriptions.
