    that you can say anything in the US without consequences.

    The old, "yelling 'FIRE' in a crowded theater" obviously is still a crime.   Perjury is still a crime, etc.

    Also, there are many civil penalties for defamation and slander.

    All speech is not protected but unfortunately our media tends to portray it as such.

      ....could be considered a clear and present danger under the Brandenberg v. Ohio standard.

      Also, there is precedent with the war crimes trials of Rwandan broadcasters.

      9-11 changed everything? Well, Katrina changed it back.

        with deference to both free speech and courts' inability to actually see blatant homophobia.

        Even the DADT and Prop 8 constitutional strike downs opinions included language suggesting "well, we really don't KNOW these laws were motivated by animus...."

        Okay.... sure we don't.

        But, I'm glad Lively's at least being called into court over this and by a serious legal counsel that has had some really big and unlikely victories at the Supreme Court.

      We don't know the full extent of what other activities Lively was involved in.

      I would not be surprised if CCR has uncovered evidence he helped author and garner support from David Bahati and others to introduce and pass into the Ugandan Parliament what is essentially a piece of genocidal legislation.

      We don't know if money exchanged hands, we don't know what deals Lively struck. What quid pro quos were agreed to.

      If the case moves forward, we may find out a lot of ugly stuff.

        It is amazing to me how much hatred and anger that some people have towards gays.

          there's just no rational reason to so vehemently hate people you've never met and don't know.

          There's no rational reason for someone like Scott Lively or Maggie Gallagher to make it their life's mission to make people suffer.

          I mean, aside from the fact that it pays well. But there are cynics and there are true believers. Lively's a true believer.
