    Had she gone to the hospital immediately (and I'm NOT blaming her for not doing so, this is meant to be instructive) she would have been given a rape exam, and they would have seen the injuries. There may have been detectable traces of any date-rape drugs that she ingested. Her physical state-the fact that she was covered in vomit and urine, and that she had clearly been dressed while unconscious-would have been proof that she was severely intoxicated-too intoxicated to legally consent.

    It would have been harder to get a conviction, yes, but it absolutely would have been possible.

    This is why it is so crucial that anyone who has the slightest inkling that they may have been taken advantage of while intoxicated seek medical attention immediately. Even if you choose not to pursue charges at that time, you will preserve the evidence in case you later change your mind-and you can get treated for any injuries as well as protected against STD's and pregnancy.
