... all on the right track, but maybe none of them correct...

    William Rehnquist
Henry Brown (justice who wrote the SCOTUS opinion in Plessy v. Ferguson)
    Sarah Palin

looks like some kind of ye olde tyme hairstyle from the 1700's or 1800's. Looks balding, or maybe someone with a 60's 'fro wearing a hat??? Just doesn't look like a modern hairstyle!

      The clue, itself is cryptic:

There's a hidden but perhaps probable message in it. (Hint, the silhouette is of a male)
"Probable message" could pertain to Obamacare or maybe Roe v. Wade...?

But I still come back to some figure from early days of the American experiment and that the figure ties in with the idea of constitutional originalism / constructionism....

      (But Sarah Palin it ain't!)

The important and difficult job is never to find the right answers, it is to find the right question. For there are few things as useless–if not dangerous–as the right answer to the wrong question. -- P. Drucker

        ... of potential Romney appointments.

Thus the author of Plessy.  Rehnquist also fits in that he dissented in Roe and every case upholding it.

The author of Lochner (Peckham) or Dred Scott (Taney) would also be appropriate.  But the silhouette doesn't look like either.
