    SCOTUS declined the case. Judge will have to re-sentence.

    In 2009 the Bush appointed prosecutor of that time pushed for 20 year sentence.

      Obama is pushing a 20 year sentence.  Heaven knows I'm used to the fact that I love some of Obama's positions and policies, and am distressed/angered/dismayed by others.  But this seemed so gratuitous.  Everything I'd read about Siegelman made me think he was railroaded for the crime of being a successful Democrat in Alabama. Why would Obama (or Holder) want to load extra punishment on him?

      BUt I didn't know enough to catch the error, that it was the Bush DOJ who made the request.

      Thanks for putting this is perspective.

        but a Bush-appointed prosecutor. btw, the reason Kagan recused herself is because she argued against Seigelman in her role as Solicitor General when federal convictions against him were dismissed.

        •  Early 2009. When Obama was dealing with a (0+ / 0-)

          potential meltdown of the financial system that threatened a world-wide depression.  When many appointments were not made and confirmed, including DOJ, and Obama was not reviewing DOJ cases.  Saying Obama pushed for this sentence is an inaccurate title.
