    When the President stated that CU erased 100 years of precedent as it related to corporations. In Alito's view because CU did not touch The Tillman Act of 1907 (which makes direct corporate contributions to candidates illegal for any candidate for federal office) the President's statement was not technically correct.

      •  eve - I am not a lawyer or expert (0+ / 0-)

        on constitutional law. However, it is an area of real interest. From what I have read most experts agree with Alito, that the President, in that SOTU speech, was not technically correct in how he phrased his criticism of the Citizens United decision. Apparently CU overturned primarily the 2002 McCain Feingold Act. While parts of CU did reach back further it was only to the 1940s, regarding other laws that it impacted.
