    If my wife and I moved to Ohio and decided to hyphenate our names our existing marriage in Washington State (read: non-Ohio marriage) would suffice for legal purposes.

    So why does this man's legal marriage in DC not suffice for the basis of changing his name? IANAL so maybe I'm off base. But this seems like a clear cut equal protection case.

      No state has to recognize a same-sex marriage performed in another state/nation.

      large portions if not all of DOMA has been declared unconstitutional by lower courts, but not SCOTUS.

      Rape apologia among progressives (well, anybody) is so very disturbing.

        currently winding its way through the legal system:  Do Texas courts have the authority to adjudicate a gay divorce?

        Courts in Austin and Dallas have heard two cases where same-sex couples, legally married out of state before moving to Texas, chose to dissolve that relationship sometime after becoming residents of Texas.

        The Austin court granted its couple the divorce. The state tried to intervene, but they were late to the boat and the appeals court rejected their intervention. They are trying to get the state Supremes to let them intervene anyway.

        The Dallas court initially granted its couple the divorce, but the appellate court reversed and remanded -- and ordered the trial court to re-instate the same sex marriage.

        Contemplate that for a moment. A same-sex couple cannot get legally married in Texas, but if they are legally married elsewhere, Texas will force them to stay married. They will even issue a court order saying, in effect, "I declare you to still be married."

        But the state does not allow or recognize same-sex marriages.

        My brain hurts. TGIF.
