  •  If a suit on these grounds didn't succeed... (9+ / 0-)

...I shudder to think of the consequences.

IANAL, but I wonder if the suit has a chance because the pill was R.W.'s property, and Spinelli was withholding her own property from her as opposed to refusing to fill a prescription.
If that suit wasn't successful and a court held that a person shouldn't be obligated to give another person their own property if it violated their religious beliefs, what legal barriers would prevent right-wing activists from stealing women's birth control pills or other contraceptives, and simply refusing to give them back because it "violated their religious beliefs"?

Wouldn't this simply give a sort of "heckler's veto" to anyone who could successfully get a hold of someone else's property that they found religiously offensive?

    •  Oh, that would be bad (7+ / 0-)

I could steal your BMW, because it was against my religion for you to own it.

Muslims and Jews could steal all the pork from the supermarket, because it's against their religion.

And Jews could also take the shellfish.

This could get interesting really fast. Not much fun, but really interesting.

Excuse me, sir. I couldn't help but hear you playing that Gibson Les Paul through that Marshall stack. I'm going to have to withhold those from you. Hand it over. Rock'n'Roll is the Devil's music. I have to do this for the well-being of our neighborhood.

Hello, neighbor. I couldn't help but detect a whiff of lobster in the air. Are you- oh, my. You are. You're preparing a lobster dinner. Someone's forgotten Leviticus! Hand it over. Thanks. Jesus be with you. Amen.

      P.S. I am not a crackpot.

Your neighbor just came home with several Nieman, Sacks, and Nordies' hanging  bags and other boutique shopping bags.

You best rush over. Wearing fabric blends is a sin. Good God! Hurry!  Save them from eternal damnation!

        •  Or show up at my door (0+ / 0-)

with a pair of scissors and a black bag, to cut off my braid and confiscate my jewelry collection.

After all, wimminz aren't supposed to wear gold jewelry or have braided hair!  The Bible says so!
