    Tom Goldstein just said on MSNBC that the penalty for not buying health insurance IS punishable, contradicting what Lawrence O'Donnell has been saying for a while about it being an unenforceable penalty.

    Who's right?

      then it seems to me that it's punishable. And it also seems that the government will have to collect the money and then disburse it. I don't think Blue Cross is a certifiable governmental authority that can collect taxes.
