      If you have had it before Sep 2010, consult an insurance agent. None of the plans written before Sep 2010 are required to be ACA compliant.

        Some ACA provisions apply to ALL plans, even grandfathered ones and this is one of them.

          I've had the BCBSTX individual plan under which I received the rebate check since 2008. So it was obviously covered by at least the MLR rebate provision of the ACA.

            Some insurance plans are honoring ACA even if they are not legally required to do so. For example, United Health Care announced they would keep preventative care coverage even if SCOTUS struck down ACA.

            BCBSTX may have made the decision to honor MLR even for grandfathered plans simply because it would be easier for them to administer all plans that way.

            It is possible that there will be plans out there who make a different decision. Certainly, creating confusion and discord during an election year is a political motivation.

            I'm happy to hear that BCBSTX did not make a political decision, opting for a more practical and humane decision, but make no mistake about it: there are others who have the option to mess around.
