    1. I think Greenwald is right about Chick-Fil-A and you're wrong.  Government would essentially be punishing Chick Fil A for their unpopular speech if they tried to prevent Chick-Fil-A from moving into their town just because the organization is anti-gay.  That is the exact sort of thing the 1st amendment was meant to guard against.

    2. I think Greenwald and the Majority in the Supreme Ct. is wrong about Citizen United, which is what many of his hypotheticals allude too.  I think governemnt has shown the ability to regulate the time, place and manner of speech OFTEN.  A couple of exmaples -

    (a) Many non-profits are prevented from endorsing or speaking on political issues to maintain their preferential tax status.
    (b) In a public forum, speakers are often limited in the manner in which they are allowed to express themselves. For instance, you are often not allowed to bring bullhorns to protests.  Another example would be "free speech zones" during political events.

    3. Money isn't speech.  Its better understood as a form of expression.  We regulate the manner and form of expression of speech in this country in many circumstances.  Therefore I think the conclusions Greenwald draws that money = speech are wrong.  It is the equivalent of saying graffiti = speech.  Just because both forms can be used to express thoughts; that doesn't mean they can't be regulated.

      Graffiti is. Money buys access to various forms of expression, including cans of spray paint if graffiti is your preferred method. They guy that can buy more paint can post more graffiti. Likewise the guy who can buy more TV ad time can use speech/video/still photos or various other forms of expression to share his views.
