      It would be like if I said there's no difference between a denial of cert and a decision on the merits to uphold a lower-court decision. It sounds like a trivial distinction to a lay person (i.e., the study from the '90s that showed nearly half of all cert denials were incorrectly reported as merit decisions by the media) -- but it's very meaningful to those in the middle of it.
