    is that SNL uses people known as "actors," which would be a cue that words are being put into someone's mouth.

    One problem is in using the Daily Currant as a source.  If one reads the Daily Currant, it is clear that the magazine is satirical.  But when the article is quoted, the connection to the satirical intent is attenuated.

    So whereas it might be highly entertaining satire in its original context, it becomes defamatory when it is repeated without a clear statement that the quotes are not actually true.

      Not only does the site carry satire tags on every page - one in the header and one in the footer, it also has a comprehensive about page which explains the site's satirical nature.

      Defamation is a serious thing. It has a legal definition. Satire - labeled or not - does not meet that definition.

      A Supreme Court case in 1989 settled all of this, and you can read about it here:

      There has been mountains of case law since this decision which gives further guidance on the appropriate standards.

THIS SITE doesn't carry those tags, and with the cross-posting,THIS SITE is now on the hook for the interpretive skills of people who (as observed by Fake Bill Nye) can't seem to grok "egg+sperm=baby"  At the VERY least, drop the body of the diary inside blockquote tags. You gotta give 'em a chance.

        And ultimately, while it would be nice for a high profile, respected scientist to come out guns blazing on this topic and maybe with these exact words, Bill Nye has a career based on educating KIDS about science, and let one partial out of context quote of this waft across the noses of many school boards out there, and Bill Nye content in middle school classrooms is gonna get yanked and walking it back is going to be damned near impossible.

        The problem is citing--on this site, which is not a satirical website--the Daily Currant and thinking that burying a snark tag puts the reader on notice.  Show me a case that addresses that aspect.

          Labeling the post as satire is only one element of the standard.

          Also to consider are things like "would a reasonable person beleive this to be true".

          "Are there any outrageous quotes? Any clues hidden in the text that its not real?"

          For example, the Smithsonian Channel doesn't even have a live morning show. The smallest amount of fact checking could reveal that.

          The night before the supposed incident, Nye tweeted that he was on a late night radio show in Los Angeles. How did he get to DC for a morning show?

          The details of the story don't add up. No reasonable person could think it was real.

            Are you serious?  One is supposed to determine whether its satire by checking on whether the Smithsonian channel has a morning show? or by checking Nye's calendar?
