Justice -- and the Justice Department -- should be at as far remove from poltics. One politicized Justice Department (bush's) was one too many.

Let us all have the strength to see the humanity in our enemies, and the courage to let them see the humanity in ourselves.

I think the failure to prosecute WAS the politicization. Basically, I'm gunning for "You do your job or they'll do theirs."

FWIW, I lived in Iowa during the 2007/2008 caucus campaign and although I did ultimately caucus for Obama, it was obvious from the start that, out of all of the candidates, he was - by FAR - the least interested in following up on the criminal excesses of the Bush administration. You might be surprised at how many people were asking about that at the candidate appearances.

there's a more benign way of looking at the politicization of the non-prosecutions (whew, there's a mouthful ;-)

It's possible that prosecutions didn't go forward due to fears of how they'd be played out in the media, and concern that getting fair trials would be impossible for that reason. That would (in my view, at least) be more excusable than holding back prosecutions to use as a political tool.

I don't claim to know to what extent, if any, this kind of thinking was in play; I'm only suggesting it as another way of looking at the picture.
