  •  The absolutist GOP and Mormon position is (13+ / 0-)

the life of the mother does NOT count.

The surrogate was given the right to abort on the basis of potential not actual physical harm.

The Romney's were given the right to abort if there were too many or too few fetuses.

They had all of this on a contract as if it was sale of a corporation. Corporations ARE people my friend.

gotten anyone stupid enough to sign away their right to abort if their life was in danger, and if they had gotten someone that stupid they probably wouldn't have wanted that person to be a surrogate.

Don't know, but I'd stay away from this one, it has backfire written all over it.

      •  No contract would prevent the surrogate from (5+ / 0-)

aborting to save her own life. That'd be an unlawful contract. Either she can be sued for breach of contract otherwise, or more likely, a court would throw it out by the time it got to Appellate Stage. (Should be thrown out at trial, but hard to say these days.)

I think any judge would say that in a case where the mother has already received harm, there is the potential for further physical harm. So actually, the surrogate has the right to abort and not have breached contract for many of the same reasons most women would. She just couldn't go "decided not to have the baby 'cause don't feel like it!" in which case she'd have been ill-advised to have become a surrogate, and it's not like women get abortions on a whim anyway.

Any attempt to make a case for outrage against Tagg for abridging or disregarding the rights of the surrogate doesn't hold water. The only thing you could get upset about is the relatively cold and abstract terms in which potential children are discussed, which is a necessity in contract law, and more than likely would put you on the side of 'personhood' anyway.

Mitt Romney creates a new anvil for us to throw at him every day, and unless Tagg starts speaking up loudly about denying women reproductive health rights, there is not much need for us to drag the family into this. Mr. Tagg Romney is a grown man and his actions only reflect so far on his father, whose involvement in this entire affair is somewhere between suspect to slim.

to get a life-saving abortion (eclampsia?) in Mitt's church; he showed up to yell at her.  At least that was the story.

That's why he showed up to yell at her. He was acting as a representative of the church, not as a rogue anti-choice avenger.

        •  That's not the story I read. (4+ / 0-)

The story I read was that she'd gotten official blessing to terminate, as her death (and the death of the fetus) were inevitable otherwise.  But Romney still showed up to berate her.

I wouldn't be surprised if he was acting on orders, to be honest. "What makes you so special" is what he said to her, and that's so...typical of the church patriarchy. What makes you so special? indeed...
