    If I remember correctly, the Court hears an appeal when four Justices vote to.  That means that on a court, five of whose members were appointed by Republican Presidents, the Ohio plan was so transparently unfair and discriminatory, it couldn't get the support of four to hear arguments.  Seven justices wouldn't even listen to it.

      Ohio Sec. of State Ken Blackwell stole Ohio for Bush in the 2004 election. Based on the fight that Husted has been putting up to deprive voters of their rights, I wouldn't be so sure that he doesn't have other ways to rig the vote up his sleeve. Also, e-voters made by a Bain Capital company will be used in Hamilton County (Cincinnati). Obama needs to be ahead by a lot larger percentage to assure a victory in Ohio.

        That does not sound good.  Betcha every eligible voter (who is not voting by mail or in person) will be e-voting a straight repug ticket.  And those that are democrat that vote by mail/in person will also magically vote using the e-voting system, thus disqualifying their vote all together!

        There are no "new" ways which is why Husted was fighting so hard for this. In fact, early voting has eliminated all that election day chaos. They've already pulled out the "scare the urban voters" card, and it's backfiring. The only one left is "challenge the ballots," which they will do but I think that will fail. Hamilton will not decide the election. The counties that will vote on paper ballots. I know we are besotted with the fantasy about hacked machines and vote totals changed by some powerful corporate source, but it is as much a fantasy as the GOP's love affair with "voter fraud" and we need to give it up in order to have our real concerns taken seriously. Please stop it.

        Take the "Can't(or)" out of Congress. Support E. Wayne Powell in Va-07.
