    vote cast in right building, where precincts vote side by side, and election workers send voter to the wrong precinct. Previously, these votes were thrown out. SEIIU got a decision that the upballot, or state/national part would be preserved from the sixth circuit.

    Ohio has not yet decided whether to appeal. the delicious irony is that this is the stronger of the two cases, and part of its strength comes from the right use of Bush v. Gore.

    This is the most important decision in this election cycle, and it represents a major victory for voters’ rights, regardless of party.  It is especially important because this was a very conservative Sixth Circuit panel, and it affirms the idea that Bush v. Gore and Sixth Circuit precedent requires some degree of uniformity and fairness in the counting of ballots.
