    whether the use of drone strikes in e.g. Pakistan is part of a lawful war. I don't think there is serious contest that the use of drone strikes in Afghanistan is illegal per se, b/c there isn't serious contest that overall the war in Afghanistan is a lawful war (that doesn't mean everything the US does is lawful, just that the war is not unlawful per se.)

    Also, even if US military actions in Pakistan is not unlawful per se, there are still questions about the drone strikes, for example targeting rescuers, which is unlawful whether or not it takes place in the context of a lawful war.
