    They're quoting the FDA's overarching policy for unapproved health messages - the policy they hold for all unapproved health messages - so accusing the flier of misrepresentation is, to put it mildly, a misrepresentation.   If you want to be wonky about it, you can find it at FDA 21 C.F.R. Parts 20 and 101 Food Labeling; General Requirements for Health Claims for Food, 58 Fed. Reg. 2478, 2525 (Jan. 6, 1993).  

    Plus the regulation you cited is about forging government seals.  That's not what this is.  They probably should face penalties for using the department logo without permission, but you're citing the wrong statute entirely.  

    If we're talking glass houses, can I point out again that the top donor to the Yes campaign is the AIDS-denialist, anti-vaccine Mercola?  It's embarrassing that so many Democrats have been suckered into this scam.   Bad science, bad policy.
