    Although the filibuster is not Constitutionally mandated, there is absolutely nothing in the Constitution that can be construed to prohibit the filibuster, and therefore, IMHO, such a ruling on Cheney's part would not be legally valid.  Since the procedure you describe could theoretically be used to invalidate any rules bothering the majority, I have to imagine the Supreme Court has a say in this.  Despite the Bush v. Gore decision, I have a feeling that, on this one, SCOTUS would be shamed into ruling against Cheney, Frist & Co. on this one.  So is this truly the end of the road?
