  •  I don't know why you think the drone (6+ / 0-)

program is "unconstitutional," but I think it is clearly in violation of U.S. federal statutory law and also international law.  Under the U.S. Constitution, treaties are the "supreme law of the land," so perhaps that's what you mean.

I'm very happy that President Obama won.  But mainly due to the drone program I contributed much less this time than last time to his campaign.  Instead, I shifted most of my contributions to local Democrats.

Now that he never again must face a vote, I hope the president will do some deep thinking and dial back the drone program.  It's extremely damaging to national security and to the way that the United States is perceived around the world.

it violates the due process clause of the 5th and 14th amendments.  it is also, as you point out, a violation of various treaties including the UN charter which we are a signatory to.

      from wikipedia

[Under the UN Charter] In order to be justified as an act of self-defense, two conditions must be fulfilled which are widely regarded as necessary for its justification. The first of these is that actor must have believed that the threat is real, as opposed to (merely) perceive. The second condition is that the force used in self-defense must be proportional to the harm which the actor is threatened.
as dennis kucinich put it today:
“The battlefield has been stretched to include nearly anywhere in the world, making it easier to justify the flouting of international law and the laws of war. But the United States is not at war with Somalia, Yemen and Pakistan.  Such killings are only lawful under a very narrow set of circumstances.  We cannot claim to be meeting those narrow circumstances when the number of people killed by such strikes, including innocent civilians, is estimated to exceed 3,000.  This number alone demonstrates that the Administration’s claims that such strikes occur only under ‘imminent threat’ is patently false."
