      Good luck getting any remedy after the election takes place.

      ... an uncertified software patch that is being applied to 39 counties' in Ohio.
      39 counties!? Yea, I wouldn't bank on Ohio being in our column tomorrow.

      •  There could be a COURT INJUNCTION (4+ / 0-)

        which would prevent the software from being used until it is carefully examined and tested, including its history of development, and the chain of command over the information tabulation process.

        They could prevent the software from screwing up the count, by insisting on having a backup system for the raw data so that it could not be mistabulated.

        Consultants could be brought in to work on the data as IMPOUNDED and under court supervision.

        This can be prevented.  Once the votes are electronically tabulated, then it could be too late, but not beforehand, unless the software is so devious that it operates before election day.

          to oversee the process and to prevent the untested and glitchy new software from ruining the vote tabulation process.

          There should be an official investigation launched now, because waiting would cause IRREPARABLE HARM to the citizens of OH and USA.

          The investigative and supervisory team would impound all data now collected and as it is collected, controlling the data collection with an iron grip, monitored so as to protect the rights of all citizens.

          2004 could be used as the reason for the need for this court action.   In addition, the OH Secy of State has repeatedly battled with the courts and has acted against the will of the courts, or has flouted their rulings, acting against the spirit of the court's rulings  In other words, the OH SOS has not been cooperative with the spirit of the court's prior interventions in OH.

            and further,

            the judge could order that if there is any substantial doubt about the validity of the vote data,

            OH must conduct a new vote within two weeks, using paper ballots - could be done using mailed paper ballots and tabulated the old fashioned way - by hand.

        It would really stir things up to get into the 2004 election scandal, which elected the wrong man to the Presidency.

        Not even 60 minutes would get permission to do that story, would they?

        and this request is unlikely to be granted. And if it is not, it isn't going to impact the election because the chances of this being true are virtually nonexistent. If it's close, the court case on provisionals could be important though. I've got to get to bed because polls open at 6:30 and I'm working, but I wish people would give up on this story. I think Fitrakis' court case is information fishing.

      and is probably just fishing for information. If i never heard of the Green Party again it will be too soon.

      The important lawsuit in Ohio is the one filed by a Northeast Ohio homeless group and other organizations regarding our secretary of state's last minute order to trash provisional ballots if a line that was supposed to be filled out by the pollworker is not properly filled out.
