  •  FL Officials Recopying Ballots, Gives West Lead??? (5+ / 0-)

TheBlaze says Allen West has pulled ahead as FL election officials recopy the ballots?  I've never heard of this before.

    http://www.theblaze.com/...

But a Republican observer who has been monitoring the counting process said West pulled ahead in Palm Beach County on Thursday as the initial count continues. Ballot printing errors led to ballots that could not be fed through scanners in some areas, so Florida election workers have been forced to reproduce their contents onto new ballots that can be read properly, the observer said. As the votes are counted for the first time, West has taken a slim lead.

CONGRESSMAN Murphy some money (although honestly, my future congressman, Ami Bera is demanding most of my cash right now!)

What is West's court petition about? I don't quite understand.  Is it that the margin that Murphy won by is too large to trigger an automatic recount?

Does FL law require that courts authorize recounts in the event that the recount isn't automatic? Does the requester have to pay?

I'm so confused about how FL does stuff. Halp!

          •  I am no expert in Florida election law, but (6+ / 0-)
U.S. Rep. Allen West lost by 2,456 votes to Democrat Patrick Murphy, according to the tallies in Palm Beach, St. Lucie and Martin counties -- placing him outside the margin  of a recount in District 18. But West is calling for a recount.
            Tampa Bay Times

Under Florida election law, this IS NOT ENOUGH to trigger a recount.

State elections spokesman Chris Cate said: "If the percentage does not fit within the statutory criteria for recounts, there exists no statutory mechanism for a candidate, group or anyone else to have a recount done by the state or any supervisor of elections.   Also, we will not know if a recount is within the required percentage until we receives the 1st set of unofficial returns from each of the counties involved.  They are not due until noon, Saturday.

            BUT:

West, whose status as an outspoken conservative and frequent cable TV guest has drawn him legions of admirers and critics nationwide, wants ballots and voting machines impounded for a possible recount even though Murphy’s lead of about 0.66 percent is larger than the 0.5 percent margin that triggers a recount under state law.
            Palm Beach Post
Ken Spillias, attorney for (elections supervisor) Bucher, filed court papers saying West’s “invitation for judicial intervention in the middle of an election is nothing short of an invitation to chaos.”

“What (West) proposes would offer any candidate the ability to halt the counting of votes and throw the entire system into disarray the moment that candidate believes that he or she is behind in the vote count,” Spillias wrote. “There is no emergency. No results have been certified, no winner had been declared. And no one is taking office tomorrow.”

The first hearing is tomorrow morning.

The bottom line: It's a mess at present.
